TERMS

Payment terms are 1%/NET 30 from date of invoice to approved accounts. We accept Visa, MasterCard, American Express and Smart Pay. Charges will be made to your credit card upon date of invoice.

Prices are subject to change without notice. In the event of a printing error, the John M. Ellsworth Company reserves the right to charge the correct price. Please confirm pricing with a representative in our Sales Department. Our prices do not include freight or any federal, state or local taxes.
Minimum $25 Order, excluding any freight charges and applicable sales tax.

Applicable sales tax will be added to all items for customers residing in Wisconsin, where the John M. Ellsworth Company is located and that do not have a tax exempt resale certificate issued by the state. If you are tax-exempt, please fax a copy of your form to 414-357-0227.

Substitution of products of equal or superior quality (due to manufacturer problems or regional availability) may be made to improve service.

Photographs & diagrams on the websites and catalog are meant to represent our products as closely as possible. Due to continuing manufacturing changes, we cannot guarantee products shipped will exactly match the pictures shown on the websites or catalog.


SHIPPING
Please inspect merchandise upon delivery and report any damage or shortage within five days by calling the Sales Department at 1-800-333-3331.

All items are priced FOB Milwaukee, WI or manufacturer location shipping point, at the discretion of the John M. Ellsworth Company, Inc., unless otherwise agreed to by the John M. Ellsworth Company. Shipping charges are extra, and will be added to invoice. Orders for in-stock items will normally ship the same day or next day. We strive to use UPS wherever possible to keep cost down. UPS cannot deliver to P.O. Boxes but we can offer shipments via the United States Postal Service upon request. If another type of carrier is desired, please indicate the company and an account number that we can bill for this service.

Partial Delivery: We reserve the right to make partial shipments. Invoices covering those shipments should be paid when they fall due.

RETURNS
No returns will be accepted after 30 days of receipt, with exception to warranty items. Returns must be received in resalable condition (new and in original package), with exception to warranty claims. All returns are freight pre-paid by the customer and may be subject to a 25% restocking charge. RETURN MERCHANDISE requires a Return Goods Authorization (RGA) number assigned prior to shipment. Please complete our RMA form here: Return Merchandise Request or obtain one by calling 1-800-333-3331 and speaking to the Sales Department. Please be prepared to provide the following information:
• Invoice or Order Number
• Item Numbers
• Your Contact Information
Returns will not be accepted without an RGA number. All packages must be clearly marked with the RGA Number and accompanied by a copy of the Returned Good Authorization Form. Items returned to the John M. Ellsworth Company without proper documentation will be subject to a restocking charge of 25%. Returns caused by customer ordering errors will be charged round trip freight, and 25% restocking charge on special order items. We are more than happy to send out vendor literature before you place the order if you are unsure of a product's capabilities.

For WARRANTY ITEMS, once the item has a positive warranty determination, a replacement, repair or credit will be issued at the Manufacturer’s discretion. All returns are freight pre-paid by the customer and may be subject to a 25% restocking charge. Credit or replacements will be issued when goods are received, inspected and the item(s) is approved by JME or once credit is received from manufacturer.

Orders CANCELLED after shipment subject to round trip freight charges. Cancellations charge on MTO (made to order) items is 25%.

THESE TERMS AND CONDITIONS SHALL CONSTITUTE THE ENTIRE AGREEMENT BETWEEN THE JOHN M. ELLSWORTH COMPANY AND THE PURCHASER, AND SHALL BE GOVERNED BY AND CONSTRUED ACCORDING TO THE LAWS OF THE STATE OF WISCONSIN AND THE UNITED STATES OF AMERICA.
